1. Agreement to Terms
These Terms and Conditions ("Terms") govern your use of the EnergyVision application and website (collectively, the "Service"), provided by BIT Technology s.r.o., a company registered in Slovakia ("we," "us," "our," or "Company"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
These Terms apply to all users of EnergyVision, whether you use the free tier or any paid subscription plan. Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms.
2. Service Description
EnergyVision is an AI-powered energy monitoring application that enables users to:
- Photograph analog energy meters (electricity, gas, water, heating, cooling)
- Use artificial intelligence (AI) to automatically read meter values via optical character recognition (OCR)
- Track energy consumption over time
- Receive forecasts of estimated energy costs
- Access personalized energy-saving tips and recommendations
- Manage multiple properties and meters (on paid plans)
3. Pricing and Subscriptions
3.1 Free Tier
The Free tier includes unlimited meters at a single property location with access to energy monitoring basics and our article library. No payment is required to use the Free tier.
3.2 Plus Weekly Plan
EUR 1.99 per week (recurring). Unlocks unlimited properties, advanced forecasting, priority AI processing, and full access to all features.
3.3 Plus Monthly Plan
EUR 7.99 per month (recurring). Identical features to the Weekly plan, offered as a convenience option.
3.4 Plus Annual Plan
EUR 49.99 per year (recurring). Best value option. Includes all Plus features plus extended data retention and export capabilities.
3.5 One-Time Lifetime Plan
EUR 89 one-time purchase. Grants perpetual access to all features for the purchasing user. Includes location-based bonuses for homeowners, landlords, property managers, and business users.
3.6 Subscription Management
All paid subscriptions are managed through the Apple App Store (iOS) or Google Play Store (Android). Billing is handled by Apple and Google respectively, following their standard terms and privacy policies. We do not store or process payment card information directly.
You can manage your subscriptions, view billing history, and cancel subscriptions directly through the App Store or Play Store settings in your device. Cancellation takes effect at the end of your current billing period. No refunds are issued for partially used billing periods.
3.7 Pricing Changes
We may modify subscription pricing upon 14 days' written notice. Price changes will apply to new subscriptions and to renewal periods of existing subscriptions after the notice period. Your continued use of the Service after a price change constitutes acceptance of the new price.
3.8 Free Trial
We may offer free trial periods for paid plans. Free trials are subject to the App Store or Play Store terms and policies. Trial cancellation must be completed before the trial period ends to avoid charges.
4. Acceptable Use Policy
You agree not to use the Service for any of the following purposes:
- Any illegal purpose or in violation of applicable laws or regulations
- Harassing, threatening, defaming, or abusing other users
- Attempting to gain unauthorized access to our systems or other users' accounts
- Uploading malicious code, viruses, or malware
- Scraping, reverse-engineering, or attempting to extract the underlying AI models
- Interfering with or disrupting the Service or servers
- Creating multiple accounts to circumvent subscription limitations
- Submitting false or fraudulent meter readings with intent to deceive
- Using the Service for commercial energy auditing or resale without permission
Violation of this policy may result in immediate account termination and legal action.
5. User Responsibilities
5.1 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to promptly notify us of any unauthorized access or use of your account.
5.2 Accurate Information
You are responsible for ensuring that all information you provide to the Service is accurate, complete, and up-to-date. This includes:
- Location and property information
- Meter identification numbers and types
- Manually entered meter readings (if applicable)
- Utility company information and tariff details
Any inaccurate data you provide will result in inaccurate forecasts and recommendations. You assume full responsibility for the accuracy of manually entered data.
5.3 Meter Access
You are responsible for obtaining proper access to any meters you photograph and for ensuring you have the right to monitor those meters. If you are a tenant or renter, you may only photograph meters with permission from the property owner or manager.
5.4 Compliance with Laws
You agree to use the Service in compliance with all applicable laws and regulations in your jurisdiction, including data protection laws and utility regulations.
6. AI Readings and Limitations
6.1 Estimates, Not Measurements
AI meter readings provided by EnergyVision are estimates and approximations, not certified or official measurements. The accuracy of AI readings depends on multiple factors including:
- Photo quality and lighting conditions
- Meter type and display clarity
- Angle and distance of the photograph
- Meter condition and wear
- AI model performance on your specific meter type
6.2 Verification Required
You must verify all AI readings by comparing them to your official utility bills or physical meter checks. Do not rely solely on EnergyVision readings for billing disputes, energy audits, or regulatory reporting.
6.3 Not a Replacement for Certified Measurements
EnergyVision readings are not substitute for:
- Official utility meter readings used for billing
- Certified energy audits
- Regulatory compliance reporting
- Insurance claims or legal proceedings
- Professional energy consulting
For these purposes, you must use only officially certified measurements from your utility provider or a licensed professional.
6.4 Error Handling
We have implemented automated validation to flag readings that are illogically higher than the previous reading (reversals). However, this validation is not foolproof. You are responsible for manually reviewing readings and correcting obvious errors.
6.5 Forecast Accuracy
Energy cost forecasts are based on historical patterns, current meter readings, and utility tariff information you provide. Forecasts are estimates and may not reflect actual bills due to:
- Seasonal weather variations
- Changes in utility rates or tariffs
- Inaccurate tariff data
- Unusual consumption patterns
- Errors in manually entered readings
Always verify forecasts against your actual utility bills.
7. Your Data and Ownership
7.1 Your Meter Data Belongs to You
All meter readings, photographs, location data, and consumption history you upload to EnergyVision ("Your Data") belong to you. You retain full ownership of Your Data.
7.2 License to EnergyVision
By using the Service, you grant EnergyVision a non-exclusive, worldwide, royalty-free license to:
- Store and process Your Data on our servers
- Use Your Data to provide the Service features (forecasting, recommendations, alerts)
- Display Your Data in your account dashboard and reports
This license is limited to operating the Service and does not permit us to sell, transfer, or use Your Data for other purposes without your explicit consent.
7.3 Data Retention
We retain your meter data for as long as your account is active. Upon account deletion, we will delete all Your Data within 30 days, subject to legal retention requirements (e.g., tax records, fraud investigation).
7.4 Data Export Rights
You have the right to export all Your Data in machine-readable format (CSV, JSON) at any time through your account settings. This right is available to all users, including Free tier users.
8. Data Usage and AI Model Improvement
8.1 Aggregated Data for Model Improvement
To improve the accuracy of our AI reading models, we may use aggregated and anonymized data from Your Data. This includes:
- Patterns across many users (no individual user identification)
- Meter reading distributions by type, manufacturer, and region
- Common AI reading errors and edge cases
Anonymization: Any data used for model improvement is stripped of personally identifiable information (names, locations, account IDs) before analysis. We cannot reverse-engineer individual users from aggregated data.
8.2 Opting Out
If you do not wish your data to be used for AI model improvement, you can opt out through your account settings. Opting out will not affect your access to the Service but may result in slightly slower updates to our AI models.
8.3 No Data Sale or Third-Party Sharing
We do not sell Your Data or share it with third parties for marketing, advertising, or commercial purposes. Your Data is used solely for operating the Service and improving our AI models.
8.4 Compliance with Data Protection Laws
Our data usage practices comply with the GDPR (EU), LGPD (Brazil), and other applicable data protection regulations. See our Privacy Policy for detailed information on how we handle personal data.
9. Intellectual Property Rights
9.1 Our Content
All content provided by EnergyVision, including articles, energy-saving tips, user interface design, algorithms, and AI models (collectively, "Our Content"), is our intellectual property or licensed to us. Our Content is protected by copyright, trademark, and patent laws.
9.2 Limited License to Our Content
We grant you a limited, non-exclusive, non-transferable license to access and view Our Content for your personal, non-commercial use only. You may not:
- Reproduce, distribute, or publicly display Our Content without permission
- Create derivative works based on Our Content
- Use Our Content for commercial purposes
- Attempt to extract or reverse-engineer our AI models
9.3 Trademarks
"EnergyVision" and our logo are trademarks of BIT Technology s.r.o. You may not use these trademarks without our written consent.
9.4 Third-Party Content
The Service may contain content from third parties, including energy-saving tips, utility tariff information, and educational articles. Use of third-party content is subject to the terms and licenses of the third-party provider.
10. Ambassador and Referral Program
10.1 Program Overview
EnergyVision operates an optional referral program (the "Program") that allows users to earn benefits by inviting others to use the Service. Participation is voluntary and free to join.
10.2 How the Program Works
When you refer a friend or colleague:
- Both you and the referred user receive 1 month of Plus features free
- You earn referral credits and progress through ambassador levels (Bronze, Silver, Gold, Platinum)
- Higher levels unlock additional benefits, including revenue share (see Ambassador Levels below)
10.3 Ambassador Levels

10.4 Revenue Share Terms
Revenue share is calculated based on subscription revenue generated from users you directly refer:
- Gold members: 10% of net subscription revenue from referrals
- Platinum members: 15% of net subscription revenue from referrals
- Revenue is calculated monthly and paid via bank transfer or as account credit
- Minimum payout threshold: EUR 50
- Payment is made within 30 days of the end of each month
10.5 Program Rules
- Referrals must be genuine users who would not have signed up without your recommendation
- Incentivizing sign-ups through payments or falsifying referrals is prohibited
- You cannot refer yourself using multiple accounts
- We reserve the right to disqualify referrals we believe are fraudulent
- Referral benefits are non-transferable and non-refundable
10.6 Program Changes
We may modify or terminate the Program at any time with 30 days' notice. Earned rewards will not be forfeited, but future referral opportunities may change.
11. Account Termination and Deletion
11.1 User-Initiated Termination
You can delete your account at any time through your account settings. Upon deletion:
- All Your Data will be marked for deletion
- You will have 30 days to recover your account
- After 30 days, Your Data will be permanently deleted
- If you have an active subscription, it will be cancelled immediately
- No refunds will be issued for remaining subscription time
11.2 Company-Initiated Termination
We may terminate your account and access to the Service if you:
- Violate these Terms, our Acceptable Use Policy, or Privacy Policy
- Engage in fraud, abuse, or illegal activity
- Attempt to gain unauthorized access to our systems
- Have not accessed your account for more than 24 months
Termination for cause will be effective immediately. We will provide notice when possible.
11.3 Data Export Before Deletion
Before your account is deleted, you can export all Your Data using the data export feature. After permanent deletion, we cannot recover this data.
11.4 Survival Clauses
The following sections will survive termination of these Terms: Limitation of Liability, Governing Law, and Dispute Resolution.
12. Limitation of Liability and Disclaimers
12.1 No Warranty
The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that:
- The Service will be uninterrupted or error-free
- AI readings will be accurate or complete
- Forecasts will match actual utility bills
- Energy-saving tips will reduce your actual energy costs
- The Service will be compatible with all devices or operating systems
12.2 Disclaimers
EnergyVision explicitly disclaims:
- All implied warranties, including fitness for a particular purpose
- Any warranty that the Service meets your expectations
- Responsibility for lost, incomplete, or inaccurate meter data
- Liability for any harm caused by relying on AI readings without verification
12.3 Limitation of Damages
To the maximum extent permitted by law, EnergyVision will not be liable for:
- Loss of profits or revenue
- Loss of business opportunities
- Loss of savings or avoided costs
- Loss of data or meter readings
- Indirect, incidental, or consequential damages
- Damages arising from reliance on AI readings or forecasts
12.4 Cap on Liability
Our total liability to you for all claims arising from the Service shall not exceed the total amount you have paid to EnergyVision in the 12 months preceding the claim. If you are a Free tier user, our liability is limited to EUR 50.
12.5 AI Reading Errors
In particular, we are not liable for any costs, damages, or losses resulting from inaccurate AI readings, including but not limited to:
- Disputes with utility companies over billing
- Loss of claims against energy suppliers
- Missed deadlines for meter readings or regulatory reporting
- Inaccurate energy audits or compliance reports
12.6 Third-Party Content
We are not responsible for the accuracy or reliability of third-party content (tariff information, energy-saving tips, external links) provided through the Service.
13. Indemnification
You agree to indemnify and hold harmless EnergyVision, BIT Technology s.r.o., and their officers, employees, and agents from any claims, damages, or costs (including legal fees) arising from:
- Your use of the Service
- Violation of these Terms
- Violation of applicable laws or regulations
- Your meter data or content you upload
- Your refusal to verify AI readings before use
- Claims by third parties related to your use of the Service
14. Modifications to Terms
We may modify these Terms at any time. We will notify you of significant changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
We will provide at least 14 days' notice for material changes that negatively affect your rights. If you do not agree to the modified Terms, you may delete your account within that period.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Slovakia, without regard to its conflict of law principles. The UN Convention on Contracts for the International Sale of Goods is excluded.
15.2 Jurisdiction
You agree that any legal action or proceeding relating to the Service shall be brought exclusively in the courts of Slovakia. You irrevocably consent to the jurisdiction and venue of these courts.
15.3 Dispute Resolution
Before initiating legal proceedings, we encourage you to contact us to resolve any dispute informally. If we cannot resolve the dispute within 30 days, you may pursue legal action in accordance with section 15.2.
15.4 EU Consumers
If you are a consumer resident in the European Union, you have the right to submit complaints to your national consumer protection authority. You may also use the online dispute resolution platform at https://ec.europa.eu/consumers/odr/.
16. Informational Content Disclaimer
Energy-saving tips, articles, and recommendations provided through the Service are for informational and educational purposes only. They are not professional energy auditing, engineering advice, or financial advice.
Before making decisions based on EnergyVision recommendations, consult with:
- Licensed energy auditors for comprehensive energy assessments
- Professional contractors for home improvement projects
- Financial advisors for decisions with significant financial implications
- Local building or utility authorities for regulatory compliance questions
We are not liable for any outcome resulting from your reliance on informational content.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be severed, and the remaining provisions will continue in full force and effect. The severed provision will be replaced with a valid provision that achieves the original intent to the maximum extent possible.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and EnergyVision regarding the Service and supersede all prior agreements and understandings. There are no other agreements, representations, or warranties between you and us, whether written or oral.
If there is a conflict between these Terms and our Privacy Policy, the Privacy Policy governs with respect to personal data handling, and these Terms govern all other matters.

20. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be made in writing and signed by an authorized representative of EnergyVision.
Acknowledgment
By using EnergyVision, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
